Iacopelli, however, wasn't going down without a fight and on April 19, 2013, he pleaded guilty to charges that he sold liquor to minors, falsifying or knowingly destroying records and making illegal purchases over $150. He received a 28-month prison sentence, three years of probation and was fined $500,000.
The court's decision came on same day that the Maryland Liquor Control Board (LCB) announced its first two felony convictions since 2008, stemming from the December 2011 raid of an Iacopelli's store in Hagerstown, MD. lawyer, John J. McCafferty, was surprised that the judge ruled in his client's favor. At the time, he said, "the prosecution is just being out-gunned by the court in plea hearing... he just doesn't think [the state] is going to be able get a conviction."
The state's attorney for Maryland, Brian Frosh, argued in court that the $400,000 judgment is maximum a judge can impose on Iacopelli if he loses at trial. According to a news release, Frosh said "the LCB is working with the Maryland Attorney General to secure restitution Iacopelli for the losses."
"I think it was a strong decision, big-city decision but a very appropriate decision," McCaffery said.
In a release, the state Liquor Control Board stated that it has already collected $2.16 million from the Iacopelli's settlement and that state agency is expected to release an additional $1.5 million in restitution to owners who were also impacted by the incident.
